Terms of Service

§ 1. General provisions
These Terms of Service set out the rules for using the RespawnKey website, available at respawnkey.com (hereinafter "Service"). The operator of the Service is Marcin Słomka, conducting unregistered business activity ("działalność nierejestrowana") under Article 5(1) of the Polish Entrepreneurs' Law Act of 6 March 2018, with the place of business in Opole, Poland, contact e-mail: [email protected] (hereinafter "Operator").
Using the Service constitutes acceptance of these Terms of Service and the Privacy Policy.
§ 2. Definitions
- User — a natural person aged 16 or older using the Service as a consumer within the meaning of Article 221 of the Polish Civil Code.
- Partner store — independent third party selling game keys (e.g., Eneba, Kinguin, Gamivo, G2A) with whom the Operator cooperates as part of an affiliate program.
- Affiliate link — a link leading to a Partner Store that allows the Operator to receive a commission from a purchase. Marked with the
rel="sponsored"attribute. - Offer — information about the price, availability and terms of purchase of a key in a given Partner Store, presented in the Service.
- Account — a set of User data in the Service enabling access to functions requiring login (wishlist, price alerts, reviews).
§ 3. User age
The Service is intended for persons who have reached the age of 16 (Art. 8(1) GDPR — age of consent for processing personal data in information society services in Poland). At registration we require confirmation of this condition.
Persons under 16 may use the Service only with the consent of a parent or legal guardian. If an account is detected as created by a younger person without such consent, the Operator will delete the account immediately upon notification to [email protected].
§ 4. Nature and functionality of the Service
RespawnKey is a game key price comparison engine. The Operator does not sell, distribute or produce game keys — it aggregates publicly available price data from Partner Stores and presents it in a transparent form.
Use of the Service is free of charge. The purchase of a key takes place exclusively in the chosen Partner Store, on the terms and conditions of that Store.
§ 5. Ranking and presentation of offers
Offers in the comparison list are by default sorted from the lowest to the highest price in the User's currency (taking into account the conversion rate from the feed synchronization date). The User can change the sorting manually (e.g., by store, rating).
The order of displayed offers does not depend on the affiliate commission the Operator receives from a given Partner Store. The Operator does not promote a chosen Store at the expense of others. Requirement of Art. 27 of Regulation (EU) 2022/2065 (DSA) — ranking transparency.
The Operator does not apply personalized pricing. All Users see the same price at a given Partner Store at the same moment.
§ 6. Affiliate links
The Service contains affiliate links. Clicking the "Buy at X" link redirects the User to the Partner Store with our affiliate identifier. If a purchase is made, the Operator receives a commission from the Partner Store.
The affiliate commission does not affect the purchase price — the User pays the same amount as when entering the Store directly. Detailed information about the model is available at Affiliate Links.
§ 7. User reviews
Registered Users may submit reviews (rating 1–5 + text 10–2000 characters) for games presented in the Service. Each User may submit at most one review per game; reviews may be edited or deleted in the account panel.
Reviews come from registered Service Users. The Operator does not verify whether the review author actually purchased and used the game — information pursuant to Art. 7(23)–(24) of the Polish Act on Counteracting Unfair Market Practices (implementation of the Omnibus Directive). Reviews undergo manual pre-publication moderation by the Operator for hate speech, illegal content, spam and overt advertising.
The Operator reserves the right to reject or remove a review if it violates these Terms, the law or community standards. Such a decision is subject to an appeal procedure under Art. 20 DSA — appeal may be filed within 14 days at [email protected].
§ 8. Reporting illegal content (DSA Art. 16)
If you believe that content published in the Service (e.g., a review, a blog post, a link) is illegal or violates the law, you can report it via the form at Report Content or directly at [email protected]. The Operator processes reports in a timely, diligent, non-arbitrary and objective manner.
After receiving a report, the Operator informs the reporter of the decision and of the available means of redress.
§ 9. User account
Account registration is voluntary. An account enables the use of additional features (wishlist, price alerts, reviews). The User may delete their account at any time from the panel /profile (Art. 17 GDPR — right to be forgotten). Procedure: immediate deactivation, full data anonymization after 30 days (cancellation window).
The Operator may block or delete an account for important reasons — in particular gross violation of these Terms, actions to the detriment of other Users or the Operator, or attempts to manipulate the ranking (e.g., mass fake reviews).
§ 10. Liability disclaimer
The Operator makes every effort to ensure the prices displayed are current (synchronization with Partner Store feeds every 15–60 minutes), but does not guarantee their real-time accuracy. The final price, availability and terms of sale are those displayed in the Partner Store at the moment of purchase.
The performance of the sales contract, key delivery, validity, after-sales service and any complaints are the sole responsibility of the Partner Store. The Operator is not a party to that contract.
§ 11. Complaints regarding the Service
Complaints regarding the operation of the Service (technical errors, incorrect offer display, substantive issues) can be submitted via the form at Complaints or by e-mail to [email protected]. The Operator processes complaints within 14 days of receipt.
Complaints regarding purchased keys should be directed directly to the Partner Store where the purchase was made.
Consumers may use out-of-court means of dispute resolution, including the European Commission's ODR platform: ec.europa.eu/consumers/odr.
§ 12. Personal data
The rules of processing Users' personal data are described in the Privacy Policy. The rules of using cookies are described in the Cookie Policy.
§ 13. Changes to the Terms
The Operator reserves the right to amend these Terms for important reasons (change of law, scope of services, security considerations). Account holders will be notified by e-mail 14 days before the changes take effect. Continued use of the Service after the changes constitutes their acceptance.
A User who does not accept the new version of the Terms may delete their account from the panel or by e-mail contact.
§ 14. Final provisions
In matters not regulated by these Terms, the provisions of Polish law apply, in particular the Civil Code, the Act on Providing Services by Electronic Means, the Consumer Rights Act, the GDPR Regulation and the DSA Regulation (EU 2022/2065).
Disputes arising from the use of the Service are settled by the court having local jurisdiction over the Consumer's place of residence (in accordance with Art. 31 of the Polish Consumer Rights Act).
